Terms of service

1. Introduction

1.1 These Terms & Conditions (“Terms”) govern your use of our website and the purchase of products from WheelWork Customs (“we”, “our”, “us”).
1.2 By accessing our website or placing an order, you agree to these Terms.
1.3 These Terms operate alongside your rights under the Australian Consumer Law (ACL). Nothing in these Terms limits or excludes those rights.

2. Products & Custom Builds

2.1 Customisation: Many of our wheels are custom-made to your specifications, including diameter, width, offset (ET), PCD, centre bore, load rating, finish/colour, and design.
2.2 Specification Confirmation: We will provide a written specification confirmation before production begins. Your written approval is final.
2.3 Your Responsibility: You are responsible for ensuring that specifications are correct and legal for your vehicle and jurisdiction. This includes brake/caliper clearance, guard/fender requirements, tyre selection, load and speed ratings, and any required engineering approvals.
2.4 Finish Variance: Minor differences in colour, texture, or gloss may occur due to coating, anodising, lighting, or batch variations. These are normal in manufacturing and are not considered defects.

3. Orders, Pricing & Payment

3.1 Quotes & Pricing: All prices are in Australian Dollars (AUD) and include GST unless otherwise stated. Quotes are valid for the period specified. Prices may change until your order is confirmed and paid.
3.2 Payment: Full payment (or a specified deposit) is required before production begins. Accepted payment methods include Visa, Mastercard, American Express, PayPal, and Bank Transfer.
3.3 Deposits: Deposits for custom orders are non-refundable once production materials are purchased or machining has started.
3.4 Lead Times: Any lead times we provide are estimates only. Delays may occur due to supply, logistics, or quality-control factors.

4. Changes, Cancellations & Cooling-Off

4.1 Custom Orders: Once written approval has been provided, custom orders cannot be changed or cancelled. If we approve a cancellation or change as a goodwill exception, you will be charged for the costs incurred (typically 10–100% of the order value, depending on production stage).
4.2 Standard (Non-Custom) Items: You may cancel standard items before dispatch by contacting us. Once dispatched, cancellation and returns are subject to our [Returns & Refunds Policy].

5. Shipping, Delivery & Risk

5.1 Delivery: We ship Australia-wide and to selected international destinations using reputable carriers. Estimated delivery times are provided as a guide only.
5.2 International Duties & Taxes: Import duties, taxes, and customs clearance fees (if applicable) are your responsibility.
5.3 Risk Transfer: Risk in the goods passes to you upon delivery to your nominated address or collection by you (or your agent).
5.4 Inspection on Arrival: Inspect all cartons immediately on delivery. If there is visible damage, note it on the carrier’s delivery docket before signing, take clear photos of the packaging and product, and notify us in writing within 48 hours. This supports any transit claims. (Your ACL rights remain unaffected.)

6. Warranty

6.1 Coverage: Our products are warranted to be free from manufacturing defects under normal road use for a period of [X months/years] from the date of delivery.
6.2 Exclusions: Warranty does not cover:

  • Motorsport, track, or competition use (unless explicitly stated)

  • Impact, kerbing, or accident damage

  • Damage from improper installation, incorrect torque, or unsuitable tyres/hardware

  • Corrosion caused by neglect

  • Chemical or abrasive damage

  • Modifications or normal wear and tear
6.3 Claim Process: If you suspect a defect, stop using the product immediately and contact wheelworkcustoms@gmail.com with your order details, photos/videos, and a description of the issue. Do not mount tyres or continue driving until we assess the claim. Remedies may include repair or replacement. If these are not possible, a refund will be offered in line with the ACL.

7. Motorsport & High-Stress Use

7.1 Any use in motorsport, track, drifting, drag racing, time-attack, off-road competition, or other high-stress conditions is at your own risk and voids warranty unless otherwise stated in writing.
7.2 For motorsport-specific options, please contact us for guidance.

8. Fitment & Safety

8.1 Professional Fitment Recommended: Always ensure hub engagement, brake clearance, stud/bolt length, torque, load rating, and tyre sizing are verified before tyre mounting.
8.2 Wheel & Tyre Packages: Where we supply a wheel and tyre package based on your written specifications, the package is deemed to fit as specified. Non-OEM stance, tyre stretch, or aggressive offsets are at your discretion and risk.

9. Liability

9.1 ACL Rights Preserved: Nothing in these Terms limits your rights under the ACL.
9.2 Limitation of Liability: To the extent permitted by law, our liability for claims not arising under the ACL is limited to:

  • Re-supply of the goods or services, or

  • The cost of re-supplying the goods or services.
9.3 We are not liable for indirect or consequential loss (including loss of use, downtime, labour, alignment, mounting/balancing, or shipping costs) except where required by law.

10. Intellectual Property

10.1 All website content, product designs, images, and logos are the property of WheelWork Customs or used under licence.
10.2 You must not copy, modify, reproduce, or exploit any intellectual property without our prior written consent.

11. Force Majeure

11.1 We are not liable for delays or failures caused by events beyond our reasonable control, including but not limited to natural disasters, strikes, carrier failures, pandemics, supply shortages, delays in shipping, customs clearance or government actions.

12. Changes to These Terms

12.1 We may update these Terms from time to time.
12.2 The most recent version will always be posted on our website and will apply to orders placed after the effective date of the update.
